Terms and conditions of the loyalty programme “KRU:Karta” (hereinafter referred to as “T&C”)

I. INTRODUCTORY PROVISIONS

  1. These T&C govern the relationships and mutual rights and obligations between Kro services s.r.o. and the participants of the loyalty programme. 
  2. Kro services s.r.o. has prepared a loyalty programme “KRU:Karta” for its customers in cooperation with other companies of the KRO Group: Kro Kitchen s.r.o., Alma Bio s.r.o. and Alma Wines s.r.o. 
  3. This loyalty programme includes the following establishments operated by the companies above: KRO Karlín, KRO Vršovice, KRO Vinohrady, KRO Coffee, Alma Prague, Vin-arna and Alma Wines.
  4. In addition to the “KRU:” loyalty programme, Kro services s.r.o. also provides gift cards and paper vouchers. 
  5. The loyalty programme is open to people aged 15 and over.
 

II. LOYALTY CARD “KRU:” 

  1. Within the “KRU:Karta” loyalty programme, there are two levels applicable: the “KRU:” and the “superKRU:”.
  2. A customer whose total spending loaded on his KRU:Card in the last 12 calendar months at the establishments listed in Article I, paragraph 3 is less than CZK 30,000 is entitled to benefit from the KRU: level.
  3. The customer eligible to the KRU: level benefits receives a credit of 50 bonus points (hereinafter referred to as “bonus”) to the loyalty account for every CZK 1,000 spent at the establishments listed in Article I, paragraph 3, within one or more visits to the establishments.
  4. A customer whose total spending loaded on his KRU:Card in the last 12 calendar months at the establishments listed in Article I, paragraph 3 is more than CZK 30,000 is entitled to benefit from the SuperKRU: level.
  5. A customer eligible to the superKRU: level benefits receives a credit of 100 bonus points to the loyalty account for every CZK 1,000 spent at the establishments listed in Article I, paragraph 3, during one or more visits to the establishment.
  6. Spending is credited to the loyalty account in real time, when a bill is issued.
  7. Spending is converted to redeemable bonuses every Monday at 6:00 a.m. For every thousand crowns collected in the previous week in their loyalty account, customer will receive a bonus of the value corresponding to their level. Any balance of accumulated spending that is less than the amount of one thousand crowns will be carried over to the following week.
  8. A customer who fulfills the condition set out in Article II(4) shall be entitled to the benefits of the SuperKRU: level for a period of 12 calendar months following the threshold of CZK 30,000 spent. If his total spending during this period is more than CZK 30,000, the customer may continue to benefit from the superKRU: level. If his total spending during this period is less than CZK 30,000, he shall lose his entitlement to benefit from the superKRU: level. He shall nevertheless continue to benefit from the KRU: level, see paragraph 3 of this Article. 
  9. The customer who uses the KRU: loyalty programme is entitled to a 5% discount on the purchase of wine, UTOPIA and EUFORIA products in the Alma Wines brick-and-mortar store upon presentation of the KRU:Card. The discount does not apply to:
    • Alma Wines vouchers
    • additional assortment such as delicatessen, spirits, oils, books, T-shirts and other Alma Wines merch, soft drinks other than Euforia
    • already discounted products and other promotions
    • tickets for tastings and other special events
    • purchase of goods in the Alma Wines e-shop.
  10. The KRU:Card in physical form can be obtained at any of the establishments listed in Article I(3), or an electronic version of the card can be obtained by registering online at www.krukarta.cz.
  11. The KRU:Card is non-transferable and you cannot redeem the bonus or claim points for transactions and spending without presenting it.
  12. The KRU:Card and bonuses can only be used after registering online at www.krukarta.cz. The registration is also a confirmation of the user account and an acceptance of the terms and conditions of the loyalty programme. 
 

III. COMMON CONDITIONS OF KRU: AND SUPERKRU: LEVELS

  1. Customers who take advantage of the “KRU:” loyalty card receive bonus points (bonuses) on their loyalty account.
  2. Bonuses can be drawn and redeemed via the Loyalty Card at the establishments listed in Article I, paragraph 3, under the following conditions.
  3. Each bonus point is worth 1 CZK.
  4. Bonuses accumulated on the Loyalty Card can be used to pay a maximum of 50% of the total spend for a specific visit. 
  5. Bonuses credited in accordance with Article II(2) and (4) may be used to reimburse a portion of the total spend whenever credited in accordance with Article II(7).
  6. Points credited in accordance with Article II(2) and (4) cannot be redeemed for cash. 
  7. The total amount of the customer’s spending is added up, so the customer does not have to reach CZK 1,000 in one visit, but for example in several separate visits.  
  8. For special events that are paid in advance via booking or ticketing systems, such as Resdiary, it is not possible to credit the customer account for technical reasons.
  9. Accumulated bonuses cannot be redeemed when paying for these special events.
  10. Group bookings of more than 20 people, catering, private events, space rentals and other individually arranged events are not eligible for credit to the loyalty programme
  11. Entitlement to the KRU: loyalty programme does not arise with the purchase of a Gift Card. The purchase of a Gift Card also does not allow the use of points already accumulated to reduce the amount to be paid for it.
  12. However, the Gift Card holder is entitled to be credited for the KRU: loyalty programme in accordance with his/her current membership level (see Article II, paragraph 3 or 5), if he/she also presents his/her KRU: Loyalty Card when paying with the Gift Card. 
  13. The current balance of unused bonuses is printed on each receipt for the payment to which the KRU:Card has been loaded. The status is also available in the User Portal at www.krukarta.cz.
  14. A Loyalty Programme Participant may request cancellation of his/her participation in the Programme at any time by sending a request by e-mail to info@krukarta.cz. Upon receipt of such a request, the Programme Operator shall cancel the customer account without undue delay and, after the expiry of the relevant retention period, delete all personal data registered by the Cardholder, thereby deactivating the relevant card.
  15. Kro services s.r.o. reserves the right to terminate the participation in the Programme of any Cardholder if the loyalty card has not been used for more than 36 months. 
  16. Kro services s.r.o. is also entitled to cancel the customer account and deactivate the card at any time if the Cardholder:
    • – intentionally provided false information during registration;
    • used the loyalty card in violation of these Rules;
    • abused the benefits of the Programme or the loyalty card;
    •  misused trademarks or otherwise damaged the good name of Kro services s.r.o., Kro Kitchen s.r.o., Alma Bio s.r.o. or Alma Wines s.r.o. 
  17. Termination of participation in the Programme or cancellation of the customer account and deactivation of the loyalty card will also invalidate all recorded bonus points, without any right to their exchange for cash or future reactivation.
 

IV. GIFT KRU:CARD

  1. The gift card can be purchased at all establishments listed in Article I(3), except for the Alma Wines brick-and-mortar store, and is valid for 12 months from the date of purchase.
  2. The gift card can be loaded with any amount, which can then be used to pay for expenses in all establishments listed in Article I, paragraph 3, except for the Alma Wines brick-and-mortar store.
  3. It can be used repeatedly until the credit is exhausted or expires.
  4. The same card can be reloaded by simply adding credit at any of the establishments listed in Article I(3), with the exception of the Alma Wines brick-and-mortar store.
  5. Gift Card credit cannot be redeemed for cash. 
  6. The gift card cannot be used to pay for special events or to make purchases on E-shops operated by the Company and its partners, when ordering goods from participating establishments via the Wolt delivery service, etc. 
 

V. VOUCHERS

  1. The establishments referred to in Article I(3) also accept previously issued paper vouchers which can be used as a one-off payment.
  2. Vouchers cannot be redeemed for cash and cannot be used again.
  3. Vouchers have a limited validity, which is indicated on the front of the voucher. 

VI. FINAL PROVISIONS

  1. Without prejudice to any other exclusion of the liability of Kro Services s.r.o., Kro Kitchen s.r.o., Alma Bio s.r.o. and Alma Wines s.r.o. in these Terms and Conditions, in addition, the Programme Operator shall not be liable as follows.
    • For all indirect damages under applicable law;
    • For any breach that is the direct or indirect result of an event beyond the control of KRO, including a failure of the network or data processing systems;
    • For any inconvenience or damage inherent in the use of the Internet, including interruption of service and total or partial unavailability of the Services;
    • In the event of a force majeure event as defined by the Civil Code.
  1. Kro services s.r.o., Kro Kitchen s.r.o., Alma Bio s.r.o. and Alma Wines s.r.o. reserve the right to unilaterally change these conditions in accordance with Section 1752 of Act No. 89/2012 Coll.
